Anti-Spam Policy

We take all spam issues very seriously. By accessing the websites of BlueHill Payments, and/or BlueHill Care (collectively, the “Products”), and agreeing to our Terms and Conditions of Service, each subscriber and user (“user, “you” or “your”) is also agreeing to this Anti-Spam Policy in its entirety. You may not use any of the Products’ software or services to:

Send unsolicited email messages (a.k.a., “Spam”) to anyone without their permission;

Send unsolicited email messages to email addresses obtained from any purchased or harvested email lists in which the recipient did not expressly request to receive your email messages;

Send email messages that harass, embarrass, defame, abuse, threaten, are libellous or slanderous, or otherwise violate the legal rights of any individual, group, or organization;

Send email messages that contain or link to pornographic or sexually explicit content, racially or ethnically objectionable content, content that directly or indirectly promotes the use of any illegal substances, content that violates laws or regulations designed to protect minors, or other content deemed to be offensive or inappropriate by BlueHill Payments, Inc.;

Send email that contains copyrighted material, including text, graphics (including trademarked material), software or other material protected by intellectual property law, for which you do not have authorization to reproduce, publish, or otherwise distribute;

Send email that contains a computer virus or other code or files that could damage, harm, or otherwise disrupt the operation of anyone else’s computer or storage device, or violate the privacy or security of any individual, group, or organization;

Perform or promote illegal activities such as starting or forwarding chain letters, illegal contests or promotions, or any other activity that is illegal;

Impersonate, use the name of (without expressed permission), or misrepresent any individual, group, or organization;

Violate any applicable governmental laws or regulations or perform any activity that would cause BlueHill Payments, Inc. to violate any law, statute, or regulation;

Allow a third party to use your BLUEHILL Payments, BlueHill Care, or BlueHill account and agree to indemnify and hold BlueHill Payments, Inc harmless from any damages or claims arising from such use by any third party;

Send any material that falls under the Michigan Child Protective Registry law; or
-
Send any material that falls under the Utah Child Protective Registry law.
You Must

Include subscribe/unsubscribe information provided by our Products and a one-click unsubscribe option in each message you send using any of our Products;

Tell recipients how to opt out of future emails from you. All opt-out methods must allow a recipient to stop all messages from you. You must ensure that your spam filter does not block incoming opt-out requests. You must honor a recipient’s opt-out request within 10 business days. You must not charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once a recipient has told you they do not want to receive more messages from you, you cannot sell or transfer their email addresses, even in the form of a mailing list;

Honor in a timely manner all unsubscribe requests sent directly to you from those who elected not to use any of our Products’ automated subscribe/unsubscribe features, regardless of how harsh or unpleasant the unsubscribe request may be;

Provide true and accurate information to be used in email headers. “From,” “To,” “Reply-TO” and routing information data must be accurate and clearly identify the person or business who initiated the message;

Not use subject lines that mislead the recipient about the contents or subject matter of the message;

Clearly identify any messages that are advertisements, as advertisements; and

Include the name and valid physical postal address of the sender in all emails.
“No Spam” and Privacy Policies
You may use our Products’ software only for “opt-in” lists, lists in which the recipient has voluntarily signed up to be on your list and has not requested to be unsubscribed. Any messages sent to users who did not request to be on your lists, whether purchased or otherwise obtained without the recipients consent, will be deemed as “Spam” and may result in termination of your account without refund and legal action, including the pursuit of damages, against you for violating this Anti-Spam Policy. You agree to indemnify and hold BlueHill Payments, Inc. harmless from any damages and claims arising from any violation of this policy. You also agree to abide by and display a Privacy Policy or link to a Privacy Policy on your list signup page. You must either: 1) use the Privacy Policy provided by our Products or 2) use a Privacy Policy that contains the same provisions as the Privacy Policy that is provided by our Products.
Any violation of this Anti-Spam Policy or any of our other policies may result in termination of your account without refund and legal action against you. You agree to indemnify and hold BlueHill Payments, Inc. harmless from any damages and claims arising from any violation of this policy. Legal Requirements
BlueHill Payments, Inc. requires all users to comply with all applicable legal requirements for email service providers, including but not limited to the CAN-SPAM Act of 2003. Depending on where you operate, you may be subject to additional anti-spam laws in certain countries. It is your responsibility to determine if you are subject to anti-spam laws, and to be compliant with these laws. BlueHill Payments, Inc. shall not in any way be responsible for your violation of any anti-spam law which may be applicable to you, and may terminate your account for violation(s) of such laws.
Changes to this Anti-Spam Policy
BlueHill Payments, Inc. reserves the right to change this Anti-Spam Policy and any of our other policies at any time, effective upon making the modified provisions available on any of our Products’ web sites. Continued use of any of our Products after any such changes shall constitute your consent to such changes. BlueHill Payments, Inc. does not and will not assume any obligation to notify you of any changes to our policies.
